Legal Aspects for Construction Contracts

NOTE-- We retired MacNail in 2000. and replaced it with Goldenseal-- a complete software package that handles construction spec writing, plus accounting, construction estimating, and project management, This manual is still online as a courtesy to die-hard MacNail users! Goldenseal has the same legal issues as MacNail-- it's just an assembler of text, and not a authority on which exact text you should use in your contracts!

Legal Aspects of Spec Writer

The text that we provide with the MacNail construction management software is copyrighted material that is the sole property of Turtle Creek Software. Contracts created from the text we provide in header and footer files and Spec Writer Clauses file are considered as 'derived works' under copyright law, and your use of them is restricted.

As a part of your license agreement, you are authorized to use any contracts or subcontracts created with Spec Writer in the ordinary course of your business. You may print contracts and use them in any form while conducting business with your clients, subcontractors, or others who have a contractual relationship with you.

You may not distribute our contract text, or contracts created with it, to others except under the conditions mentioned in the preceding paragraph. Nor may you distribute our program or any non-contract files to any other parties.

You should not remove the copyright notice at the end of each contract unless you have used your own text to entirely replace the text provided in Spec Writer portion of the MacNail project management software . Other companies that receive your contracts created with Spec Writer may not use our text in contracts with parties other than yourself.
